Intended parents in a surrogacy process

Intended parents in a surrogacy process are the persons who make the decision to enter into a contract with the surrogate in order to carry a pregnancy and have a child. In countries where surrogacy is permitted, these intended parents will be the sole legal parents of the newborn.

Requirements of intended parents in a surrogacy process

In countries such as Ukraine and Georgia, the surrogacy process is only allowed for heterosexual couples or heterosexual married couples whose woman has no reproductive capacity or whose pregnancy may pose a serious health problem for her or the baby.

In places like Mexico City, Cancun or Colombia, there is a much more permissive policy, and therefore any family model is allowed, from single men to couples of girls, including married couples and heterosexual couples.

What is the age limit for intended parents?

The age limit for intended parents in a surrogacy process varies depending on the legislation of each country. In most countries such as the United States, Ukraine, Georgia, Colombia or Mexico there is no age limit, but in other countries such as Greece, the intended mother must not exceed 50 years of age.

What is certain is that there is a clear recommendation, and that is that the intended parents should not exceed 50 years of age.

Obligations of intended parents

Both the rights and obligations of the surrogate or surrogate mother are established in a contract or agreement signed between the intended parents and her, always within the legislative framework of the country or state where the surrogacy process is carried out.

Establish subrogation agreement

Intended parents have the right to enter into a legal surrogacy agreement that details the terms and conditions of the process.

Participating in the fertilisation process

Parents shall have the right to decide on fundamental aspects related to in-vitro fertilisation and embryo transfer, always within legal and medical limits, such as the embryos to be transferred.

Registration of the baby in the name of the intended parents

The newborn child shall be registered in the name of the intended parents, the surrogate will not appear in the register, and therefore they shall be the legitimate parents.

Rights of intended parents

Payment of costs and compensation to surrogates

Intended parents are obliged to pay the costs related to the process, including medical expenses, legal fees, and costs and compensation related to the pregnant woman.

Respect the terms of the agreement with the surrogacy agency

Before signing an agreement with the surrogate, an agreement is signed with the surrogacy agency that coordinates the entire process. These agreements include the dates of travel to the destination country.

Assuming legal responsibility for the newborn

Once the child is born, it is the intended parents who have the legal obligation to assume responsibility for the child, providing the necessary care and protection.
